Domestic Violence has, in recent years, taken centre stage in the family law dynamic, and appears to be being magnified by an attempt to change the national psyche.

Any allegation of Domestic Violence will inevitably change the way a family law dispute is viewed and managed.

Allegations of Domestic Violence are taken extremely seriously, and alter the entire character of the way the Court process works, so far as that particular matter is concerned.

Two important rules emerge from this:-

(i)??????????????? Make an allegation of Domestic Violence only if it is warranted.

(ii)????????????? Never, never, never admit to or concede an allegation of Domestic Violence if it is inappropriate to do so.

1.???????? MAKING AN ALLEGATION

It is common perception that there must be physical violence, where one party must strike another, in order for an allegation of Domestic Violence to be supported.? This is not so.? Any course of conduct or single act which has the effect of making a reasonable person fearful will be sufficient.? A complaint of Domestic Violence can be made through the Courts, and conducted by the parties or a law firm, or can be made by and conducted through the Police Service.? The Police have wide-ranging powers as a result of complaints or attendance at domestic disputes, to remove the party who seems a threat, to hold them in custody temporarily, and to conduct Domestic Violence applications, regardless of that party?s intentions.

Safety of the parties is paramount and the Police will act to remove any person who seems a threat.

You can also commence Domestic Violence proceedings, and it is reasonably easy to obtain an interim Order, given that Magistrates are far more likely to act with caution until all of the facts are known, and will make Orders (often mutual orders, that is, orders binding both parties), until there is an opportunity to have a hearing on the facts.

There is often pressure on parties to make mutual ?tit for tat? cross applications alleging Domestic Violence. ?This should only be done if the facts support such allegations.

Domestic Violence Hearings and Orders are a major distraction from obtaining final outcomes, and often stand in the way of getting matters resolved.? They can also be an enormous drain on funds, and if allegations are not later proven to be true, will seriously damage your prospects in related Court actions.

Simple things like the hand over of children to spend time with the other parent, become fraught with logistical problems and opportunities for parties to make allegations which ultimately simply waste money and time.?

Parties are often tempted to use Domestic Violence applications and interim Orders as a tool.? This can seriously backfire.? Interim Orders interfere with contact handover and unnecessarily complicate matters, if they are not necessary to regulate the contact of the parties.? They should be resisted as a tactic to ?get at? your Ex. It simply doesn?t work.? It?s a distraction, time and costs waster and can blow up in your face if the facts do not support you.

The parties are often under pressure to make what are called Consent Orders without admission.

This is, in effect, where the respondent (or both parties if there are cross applications) denies the allegation of Domestic Violence, but agrees to be bound by an Order to keep away from and have no contact with the Applicant.

You should resist the temptation to ?nod? to such an Order if the allegations against you are untrue.? These Consent Orders, even without admission, will cause major problems with the conduct of the main Family Court proceedings, and may prejudice or at the very least alter the course of contact with the parties and their children, and affect final resolution of the matter.

Conversely, allegations that are later proven to be unfounded can be seriously damaging to your credibility.?

The message is clear:-

(i)??????????????? only ever make an allegation if it is supported by fact;

(ii)????????????? do not consent to Orders, even without admission, unless it is appropriate to do so.

2.???????? THE COURT PROCESS

Domestic Violence hearings have 3 stages:-

(i)??????????????? Initial Order;

(ii)????????????? Interim Orders and Interim hearings;

(iii)???????????? Final Orders.*

3.???????? INITIAL PERIOD

Domestic violence orders can be initiated by one of other of the parties.? The process involves filing an application in the appropriate court and your adviser can draft the material for you. Often though the process starts with an event of violence or a domestic incident.

Police Officers have the power to obtain initial orders binding the parties until a Court can hear the matter.

This is usually overnight, or for very short periods of time.? Police attending a home will initially try to make a value judgment about removing someone from the site to prevent further possible violence.? If that decision is made then that person will be removed and police will seek to obtain an interim order preventing contact between the parties until a Magistrate can look at the facts.

The parties will then turn up to a ?first return date?. This is the first time that anyone actually looks at the facts.? Prior to this the only focus is on taking precautions to try to ensure that any violence stops.? Police will make that decision out of an abundance of caution and will be concerned about the consequences of not acting.? As a result it is very common for someone to be removed from the scene.

This does not mean that violence is proven.?

It simply provides a circuit breaker for the situation.

4.???????? INTERIM ORDERS AND INTERIM HEARINGS

Regardless of whether the matter is police initiated or by application filed by a party, the matter will then go before a Magistrate who will consider making an interim Order.

As I have previously mentioned, these Orders are made on very conservative grounds, and it is more likely than not, that an interim Order will be made.

Everyone appears at the local Magistrates Court on the morning of the first return date.? There are several possibilities for what happens on that date and it depends upon the attitude of the parties and to some extent the police (and certainly the Magistrate), as to what orders if any are ultimately made.

There are three possibilities:

a)??? there are no orders made and the matter is dismissed (quite rare);

b)??? there are interim orders made and a final hearing date is set;

c)??? there are final orders made by consent.

It is possible though exceedingly rare that no orders are made at this first return date and the parties return to a situation as though police never attended or intervened.? Even if you or your partner withdraw the complaint, the police have the discretion to continue.? They will do so if they believe the complainant is being intimidated or overborne into making a decision to withdraw.

If the matter is not dismissed at this first date, then some orders will be made.

Whatever happens unfortunately there will not be a full examination of the relationship and the facts behind any incident on this first return date.

What will happen is that the parties representatives (or the police prosecutor if the parties are unrepresented), will have a look at the facts as alleged.

There will then be a discussion about whether some orders can be made by consent.

They can take many forms and have lots of variations.? They may in fact contain mutual obligations for the parties to remain away from each other.

If some kind of common ground on order can be found, then consent orders can be made.? These can be interim (until a full hearing can be held), or final.

Interim consent orders are the most common but if there is complete agreement on the way forward then final orders can be made by consent.? DO NOT CONSENT TO FINAL ORDERS WITHOUT UNDERSTANDING THE FULL CONSEQUENCES OF DOING SO.? Final orders have far reaching consequences.? They create obligations and problems which will stand for years.? They are difficult to undo or alter without the consent of your Ex (which may not be given).? Even if the orders are made ?Without Admission?, that is, without conceding that you?ve done anything wrong, they will affect not just the way contact with any children is conducted, it may affect how the rest of the finalization of the relationship is managed.

As I previously stated, there has been a trend in years gone by to encourage the parties to make ?mutual orders without admission?.? This means, so it?s claimed, that the parties effectively agree to stay away from each other without admitting any of the allegations made by the other.? This was a relatively easy way to dispose of the allegations on the first return date, either in an interim sense or in final orders, without going through the whole costly antagonistic process.? This was often sold to the parties as saving costs and ?getting on with the important stuff?.? This is the wrong way to look at what is a very serious matter.

Domestic violence orders can have a major affect on the shape duration and consequences of he entire process of unraveling a relationship.

Think carefully about the instructions you give your adviser.? Do not feel rushed and if you cannot make a decision you?re happy with, keep talking to your adviser and those close to you until you can.? Remember, your adviser is not there to demand that you do various things.? Your adviser is there to explain the law and circum stances to you, and make recommendations to you about what you CAN do.? You adviser is definitely not there to tell you what to do or put problems in your way.

Your adviser is required, after explaining the situation to you, to take and implement your instructions unless they are illegal or unethical.? If your adviser is unprepared to do that then he/she should withdraw and allow you to get another adviser.

Unfortunately some, even senior lawyers, do not know or forget this.

If there is not enough common ground for consent orders then, there may need to be, or the parties may require, an interim hearing.? This is, necessarily, less than a full-on examination of all the facts.? There will be argument from both parties some submissions regarding what Orders, if any, would be appropriate.

It is acknowledged that the parties will not have had any time to gather evidence, collect witnesses and prepare for a hearing.? For this reason final orders are not made on that day.?? You may feel a certain amount of frustration in not being able to ?have your say?.? Ultimately it is best for both parties if the facts to emerge once all the information is to hand and a proper examination of everything can be made.? This takes a little time.

At an interim hearing, the decision to be made is, ?what step will best put the matter into a holding pattern until a full review can be done?.? For this reason interim orders against one or both parties are very common.

It is an unfortunate side effect of this approach that many people have interim orders made against them in circumstances that are very superficial.? People are subject to the stigma of an interim domestic violence order based on only a cursory examination of the facts.? This is traumatizing and is even worse when children are involved.? Trying to explain this process to a small child is extremely difficult.? Contact (now called ?Spending Time?) with children almost universally means contact with the other parent, which, of course, can?t be done under interim or final orders.? Your adviser will have strategies and processes to go in the order to make this work.

The thought of ?engineering? an interim order might be tempting as a way of scoring points against an Ex but it immeasurably complicates the process and will make the prospects of getting a resolution plummet.? It is extremely dangerous to play with this process and there are severe penalties for being caught doing so.? You should only make a domestic violence complaint if there are grounds to do so.

One of the worst features of interim orders is the impression it gives some parties.? All sorts of feelings of revenge, alienation, superiority, and other impressions which act to move the parties further apart, spring from the (often wrong) impression of the rights granted at these interim hearings, to say nothing of the additional costs incurred.

Interim orders will, of necessity mean one party leaving the home, usually at no notice.? This can be a good thing in relationships of genuine fear and danger.? It can be the first real step in a realization that a relationship isn?t working.? It can also harden attitudes.

None of this should enter into your thinking of you are in danger or fear.

If you need to make a call to end violence an intimidation, do it.

If those Orders are not final and by consent, then those Orders will stand but the matter will be set down for a full hearing, and directions will be made by the Court as to dates for preparation and service of material to support or refute the allegations.

5.???????? FINAL ORDERS

At that final hearing, both parties will by then have filed affidavits and setting out their versions of the facts, but both parties will be required to be cross-examined on that material, and answer questions from their opponent?s legal adviser designed to disprove the allegations.

The Magistrate will then decide which version of the facts he or she accepts, and make orders accordingly.? The proof of the allegations is of the civil standard, that is, on the balance of probabilities.? This means that the Magistrate will only have to decide whether it was more likely than not that the allegations are true.? There is no requirement to prove the allegations beyond a reasonable doubt.?

It is a particular problem for the parties and the Court that most often, these allegations are of conduct between the parties in private, with no other witnesses, and are often alleged to have stretched over a period of time, making dates, times and places difficult to pin-point (and refute).

There is no requirement for corroborating evidence, (that is, some kind of independent evidence, for example, medical evidence, evidence of complaint at the time, or physical evidence), in order for the allegations to be accepted.? This introduces an element of jeopardy and almost chance into the Domestic Violence arena, which is unwelcome by the parties or the Court.? Nonetheless, it is present and has to be dealt with and considered by the parties.

6.??????????? APPEAL

There are only 4 grounds of appeal:-

(i)??????????????? That the Court has allowed evidence that should have been excluded.

(ii)????????????? The Court has excluded evidence that should have been allowed.

(iii)???????????? That the Court misunderstood the law.

(iv)???????????? That the Magistrate so misunderstood the facts as stated, that no reasonable person could have come to the conclusion that he or she did.

As you can see these appeal grounds are quite narrow.

Orders made will be expressed to exist for a particular period of time, and may be very, very specific, covering minimum distances of approach, specific areas or places which are not to be entered, and particular conduct which is not permitted.

On expiry of the orders, they can be extended depending upon the conduct of the parties in the interim.

7.???????? SIDE EFFECTS

Allegations of Domestic Violence can alter the way your family law dispute is conducted.? Matters affecting the children will be delayed, complicated and made far more expensive for all parties, by unfounded allegations.

Likewise, consenting to Orders relating to Domestic Violence, will slow down, complicate and make more expensive, all of the other dealings related to the dispute. ?Orders relating to contact with, maintenance of, and the residence of children will all have to be looked at and made more complicated by allegations made.

If this is required for the safety of the parties or the children then, so be it, and this is quite appropriate.

Using Domestic Violence as a weapon though, is often counter-productive and will harden the attitudes of all of the players to a resolution.? This will increase the chances of the matter becoming one of the 7% or so of disputes that goes to the delay and expense of a full Trial of all the property and children issues.

If you need to make an allegation for Domestic Violence in order to be safe and to make suitable arrangements for children, then do so, and stick to those allegations without watering down or embellishing them.? If not, resist the temptation to make unfounded allegations.

It is essential that, if your relationship has been marked by domestic violence, you take advice on structuring your termination of it and that you have a domestic violence safety plan before you make the break.? You should seek advice on how to do this.?

Sleep apnea has been linked to a higher risk of cancer.??

That?s according to two new studies done by Spanish researchers and the University of Wisconsin.

Researchers found that people with severe sleep apnea were at nearly five-times the risk of cancer.

Study author Dr. Javier Nieto, with the University of Wisconsin School of Medicine and Public Health said that the study originated from previous research that found that skin cancer tumors grew faster in mice that were periodically deprived of oxygen.

The author of the study at the University of Wisconsin says treating the condition in cancer patients will increase odds for survival.??

The disease has already been linked to several health problems, such as heart disease and high blood pressure.

Today, it was able to dismiss its opponents' state law unfair competition claim under the theory of federal preemption. Essentially, Aereo argued (and the judge agreed) that the anti-competition claim was actually an attempt to vindicate the broadcasters' rights to control the performance of their copyrighted materials. Because those rights are granted under federal law, the state law claim was preempted and dismissed from the lawsuit pursuant to the Copyright Act. Despite this courtroom victory, Aereo still has a lot of legal legwork to do, as it still faces two copyright claims that could still shut down the OTA streaming party. Stay tuned.

Lockerbie bombing convict dies in Libya

"He died an hour ago," his brother Abdelhakim al-Megrahi told AFP, putting the time of death at shortly after 1 pm (1100 GMT).

A Scottish court sitting in the Netherlands convicted Megrahi in 2001 of the bombing of Pan Am flight 103 over the Scottish town of Lockerbie, which killed all 259 on board the jet along with 11 people on the ground.

Most of the passengers on board the Boeing 747 jet headed from London to New York were Americans.

Megrahi, 60, who suffered from prostate cancer, was released on compassionate grounds in 2009 after doctors said he had only three months to live.

His death on Sunday prompted sharply contrasting reactions.

The US government, which was outraged by Scotland's decision to free the former Libyan airline security chief in 2009, said his death ended an "unfortunate chapter."

British Prime Minister David Cameron, meanwhile, said the Libyan should never have been released from prison and rejected calls for an inquiry into his conviction.

"Megrahi's death concludes an unfortunate chapter following his release from prison in 2009 on medical grounds -- a move we strongly opposed," said US National Security Council spokesman Tommy Vietor.

"We will continue working with our new partners in Libya toward a full accounting of Kadhafi's horrific acts," he added.

Megrahi had always maintained his innocence, arguing that US agencies "led the way" in securing his conviction, and his brother Abdelhakim defended him on Sunday, saying he was the "scapegoat" of Moamer Kadhafi's regime.

"He has died and has left us with the feeling of injustice," he told AFP. "Everyone knows that the Kadhafi regime blamed its mistakes on others."

Another brother, Mohammad al-Megrahi, too insisted Abdelbaset was innocent.

"All the darkness of the universe will never cover the flame of the candle which is the truth," he said, speaking outside the family home where relatives had gathered to receive condolences.

Some have suggested the decision to allow Megrahi to return to Libya was taken to smooth the way for oil lucrative deals struck by British firms.

Scotland's First Minister Alex Salmond argued that Megrahi's death vindicated his administration -- which can make decisions on justice matters independently of the British government.

His death "puts to rest some of the conspiracy theories which have attempted to suggest that his illness was somehow manufactured -- today's news confirms what we have always said about his medical condition", Salmond said.

The convict had been greeted as a hero on his return to Kadhafi's Libya, after having served eight years of a minimum 27-year sentence for his role in the Lockerbie bombing.

The fact that he survived much longer than the doctors had estimated provoked indignation in Britain and the United States.

On Sunday, the British premier said Megrahi's death was a day to remember "the 270 people who lost their lives in what was an appalling terrorist act."

Cameron added: "I've always been clear he should never have been released from prison."

He also dismissed calls for an inquiry into his conviction.

"There was a proper process, a proper court proceeding and all the rest of it. We have to give people the chance to mourn those that were lost. I'm very clear that the court case was properly done and properly dealt with."

But the father of one of the victims of the Lockerbie bombing, who has long believed Megrahi was innocent, said it was a sad day.

"It is a sad time, I think. I have been satisfied for some years that this man was nothing to do with the murder of my daughter," Jim Swire, whose daughter Flora was killed in the attack, told BBC TV.

"I think Scotland has a big question to answer as to why his verdict hasn't long since been reviewed."

Swire said Megrahi had been in great pain when he visited him in Tripoli in December, and that he thought it would be their last meeting.

"He was in a lot of pain, and his demise now has at least relieved his pain for him," Swire said.

"So from now on perhaps we can concentrate on trying to find out who did murder my daughter and all those other people."

Swire, a member of the Justice for Megrahi (JFM) group, said he was confident that the guilty verdict passed on Megrahi by a Scottish court sitting in The Netherlands in 2001 would be overturned.

But several relatives of US citizens killed in the Lockerbie bombing said on Sunday they were pleased that Megrahi had died.

"He deserved to die," said Susan Cohen, whose daughter Theodora was one of the victims.

"He was a mass murderer. I feel no pity around him. He got to die with his family around him. My daughter, at age 20, died a brutal, horrible death," she told CNN.

In December, Megrahi told several British newspapers in what was billed as a "final interview" that a book being written by investigative journalist John Ashton would clear his name.

"I am an innocent man," he told the papers, including The Times and the Daily Mail.

"I am about to die and I ask now to be left in peace with my family," he said.

Megrahi's funeral was due to take place on Monday afternoon, Libya's Lana news agency quoted one of his sisters as saying.

NASA, SpaceX Aim To Launch Private Era In Orbit

A private spaceship owned by a company called SpaceX is scheduled to blast off from Cape Canaveral in Florida early Saturday morning.

If all goes well, the unmanned capsule will rocket up on a mission to deliver food and other supplies to the International Space Station, becoming the first commercial spacecraft to visit the outpost.

The highly anticipated mission could mark the beginning of what some say could be a new era in spaceflight, with private companies operating taxi services that could start taking people to orbit in just a few years.

SpaceX and NASA have been working hard to make this launch happen ? and that has meant navigating the cultural differences between this small, young startup and the huge veteran space agency.

"I feel very strongly that SpaceX would not have been able to get started, nor would we have made the progress that we have, without the help of NASA," says Elon Musk, who founded SpaceX in 2002 after making a fortune with the Internet firm PayPal.

Musk says he runs his rocket company like a Silicon Valley tech firm. "That's the operating system that I have in my head of how to run an organization. And that's how I've created SpaceX," says Musk. "NASA is obviously coming from a different heritage."

For five decades, NASA was American spaceflight. Now, the space shuttles are going to museums ? Discovery is already in the Smithsonian. And the government wants NASA to focus on deep space exploration, while relying on private space taxis to take cargo and people back and forth to the nearby space station.

NASA has been working with companies to make sure that vision of the future will happen. It has a cargo delivery contract with SpaceX worth $1.6 billion. The space agency has also been handing out plenty of advice.

Musk says so far, their collaboration has worked well: "No relationship is perfect, certainly. But on balance, it's really good."

The relationship involves daily calls and emails between people who live in two different worlds.

For example, the workforce at NASA is generally older. Many top managers cherish their childhood memories of watching the Apollo astronauts on TV.

Not so at SpaceX, where Musk says the average age is around 30. "At age 40, I'm relatively old," says Musk, who notes that he was born after the moon landing.

Like other tech companies, SpaceX tries to have a flat organizational structure, says Musk. The idea is that everyone can talk to everyone else, without having to go through chains of command.

"We really try to minimize any unnecessary paperwork or any bureaucratic elements," says Musk. "I think it's also easier, if you are a smaller organization than if you're a larger organization, to be more nimble."

SpaceX and NASA also have deeper cultural differences. People at NASA feel the weight of the space agency's long history, which includes heartbreaking tragedies.

Wayne Hale, a former space shuttle program manager who recently retired from NASA after working there for more than 30 years, notes that "you go through life and you have experiences and bad things happen, and from those experiences you learn perhaps to be more contemplative when you have to make choices."

For engineers, that contemplation means running more tests and doing more analysis. To a certain extent, that's a good thing, says Hale, but it costs both time and money.

"To build a lower-cost system, you need to perhaps draw the line back and not do so much," says Hale. "And that's what we're seeing with the commercial space people."

Michael Horkachuck, a NASA official who has been managing work with SpaceX, has noticed cultural differences.

"They're a little bit different in that they like to build the hardware and test it, and if it doesn't work and breaks, then they'll build another piece with a little change and test it again, and not do quite as much documentation and detailed analysis as necessarily NASA would typically do," says Horkachuck, who notes that it reminds him a bit of how the Russians approach space technology.

But he says sometimes SpaceX sees the wisdom of NASA's ways.

"SpaceX is learning how we do things and why we do things," says Horkachuck, "and I think they are pulling some of the best ideas and methods that NASA has had and applying those to their program."

One thing that makes this give-and-take go a bit more smoothly is the fact that a fair number of the approximately 1,700 people working for SpaceX used to be employed by NASA ? Musk estimates that's true of about 10 to 15 percent.

Jon Cowart, a NASA manager assigned to partner with SpaceX as it develops a vehicle that can carry astronauts, says having former NASA colleagues at meetings can really help when agency officials and SpaceX are trying to relate to each other.

"It makes it a lot easier to find that common ground as we struggle to find the right answer on a way they plan do to something that we may or may not be comfortable with," Cowart says.

Despite their differences, NASA and SpaceX share a set of core convictions. They both have an almost religious belief in the need for humans to venture forth into space, a geeky love for rockets, technical know-how ? plus, they both need each other to succeed.

Some people even say SpaceX reminds them of NASA, back in the good old days.

"I would characterize them as almost being like back during Mercury, and Gemini and Apollo," says Cowart. "That kind of youthful, you know, young enthusiasm that you have when you're first starting something."

Review: 4-cylinder Ford Escape strikes the right tone

We?ve seen this movie before: Stagnant economy. Soaring gas prices.?Government-mandated increases in fuel economy that doom the big vehicles Americans prefer.

In the 1970s, automakers responded to those conditions with that they called ?downsizing.??Cars became cheaply made, cramped and slow.?For some reason, consumers weren?t thrilled with these new models. The quick-and-dirty solution was to bolt a turbocharger onto their wheezing, underperforming four-cylinder engines with the promise of hot performance and good fuel economy.? Sailors have made more reliable promises to girls in foreign ports.

The technology was immature and the result was unreliable: short-lived engines with poor dynamic driving qualities. Ford was one of the culprits, with turbocharged four-cylinder engines offered in models like the Mustang and Thunderbird, which were traditionally powered by V8s.

But that was a long time ago.? In response to pricey gas and more stringent federal fuel economy standards, Ford is rolling out a family of smaller turbocharged engines to replace bigger, thirstier ones.? And this time, Ford got it right.

While the V6 engine option was popular in the outgoing Escape compact SUV, the 2013 Escape will offer only four-cylinder engines.? Can such engines really match customers? power expectations? Yes they can. Especially when they are the turbocharged EcoBoost engines that Ford offers as an upgrade from the base engine.

The base engine is an update of 168-horsepower, 2.5-liter four-cylinder seen in the outgoing model and it is a good one for budget-conscious drivers, with 22 mpg city and 31 mpg highway.? But things start to get more interesting with the next step in the lineup, with a 178-hp turbocharger EcoBoost 1.6-liter four-cylinder.

That's an incredibly small engine to expect to move a 3,500-plus pound SUV, but thanks to modern turbocharger technology it makes both the peak power and the low-speed torque to move the Escape with good hustle.? It has marginally better horsepower, torque and fuel economy than the base engine, a combination that makes it an appealing upgrade.? The EcoBoost 1.6 offers the maximum fuel economy among the Escape?s engines, with 23 mpg city and 33 mpg highway.

A lot of buyers liked their V6 engines, though. What are they to do? The 240-hp 2.0-liter EcoBoost four-cylinder is the answer for them. Ford did extra homework on this engine, giving drivers more power than the old model?s V6 with fuel economy nearly equal to that of the base engine, at 23 mpg city and 30 mpg highway.

But just as importantly, Ford engineers sweated the detailed needed to make the EcoBoost 2.0 smooth and quiet enough to serve as a legitimate substitute for a V6. This is the area where carmakers will see the most resistance from customers, because V6 and V8 engines are smooth and quiet, with a refined exhaust note.? Four-cylinders are inherently raucous, challenging engineers to find ways to tame their obnoxious nature if upmarket customers are to accept them.

Ford has achieved that with the 2.0 EcoBoost.? The 1.6 EcoBoost targets a customer with a sportier mindset who might want to hear the engine a little bit, so it is louder, but the 2.0-liter is thoroughly muffled.

That quietness is indicative of the 2013 Escape?s overall refinement. Like the Ford Focus compact car on which it is based, the Escape is a notch above its competitors, providing a rich feeling driving experience. Unlike the Focus, the Escape enjoys a proper automatic transmission, with six gears and slick shifts, so the Escape won?t chase away potential buyers with an irritating, rough-driving automated manual transmission posing as an automatic.

The Escape?s cabin is opulently detailed, and even the entry-level models have pleasant soft-touch surfaces. The thick-rimmed steering wheel connects to excellent steering that provides superb feedback. The Mazda CX-5 is the Escape?s only equal dynamically, and the Escape has less road and wind noise inside for a more placid passenger space.

Like other new Fords, the Escape boasts an improved version of the annoying-to-use Sync voice command system and MyFord Touch touch-screen infotainment systems. The latest iteration is less of a pain in the, er, neck to use but still falls short of the simplicity and convenience of properly designed knobs and switches. At this point MyFord Touch remains an exercise in technology for technology?s sake, so we look forward to the next upgrade. We?d still opt for the conventional radio and climate controls.

But here?s a tiny electronic detail they got right: the turn signal. Seems simple enough, but in recent years Ford and other carmakers have decided that it would be better for the control stalk to return to center, even when you?ve activated the turn signal. For the Escape they?ve gone back to having the stalk remain in the raised or lowered position if the turn signal is on, letting you know it is still on and making turning it off simple. When the stalk is already in the middle, how do you cancel a turn signal?

Other electronic gimmicks: a tailgate that opens and closes remotely by kicking your foot under the rear in the manner of an old straight-ahead field goal kicker (props to Redskins kicker Mark Mosley, 1982 NFL MVP, the last straight-ahead kicker and the only kicker ever named MVP!).? And electronic grille shutters that block airflow to the radiator at highway speeds to trim aerodynamic drag and boost fuel economy.

The ?U? in SUV does stand for ?Utility? and Ford added that in the Escape by stretching the vehicle?s wheelbase and adding most of that newfound space to the rear seat for more passenger legroom. The cargo area is also larger for that ubiquitous ?stuff? people cite when explaining their need for an SUV rather than a sedan.

The Escape marks our third consecutive compact SUV review, as this hotly contested segment turns over this year. That?s because compact SUVs are second only to sedans in popularity, and the two groups account for 60 percent of new car sales.

With impressive innovations like EcoBoost providing an excellent combination of power and frugality, it is easy to see why these vehicles are attracting a large following.

(AP) ? The western United States and eastern Asia will be treated this weekend to a rare solar spectacle when the moon slides across the sun, creating a "ring of fire."

But scientists caution would-be viewers to be very careful because the sun's damaging rays will remain powerful even during the annular solar eclipse. The advice: Either wear specially designed protective eyewear or attend a viewing event ? at a planetarium or amateur astronomy club, for example ? to avoid risk of serious eye injury.

The solar spectacle will first be seen in eastern Asia around dawn Monday, local time. Weather permitting, millions of early risers in southern China, northern Taiwan and southeast Japan will be able to catch the ring eclipse.

Then, the late day sun (on Sunday in the U.S.) will transform into a glowing ring in southwest Oregon, Northern California, central Nevada, southern Utah, northern Arizona and New Mexico and finally the Texas Panhandle.

For 3 ? hours, the eclipse follows an 8,500-mile path with the ring-of-fire phenomenon lasting as long as 5 minutes, depending on location.

Outside this narrow band, other parts of the U.S. and portions of Canada and Mexico will be treated to a partial eclipse. The Eastern Seaboard will be shut out, but people can find online sites that plan to broadcast the event live.

It's impossible to know how many people plan to make an event of the ring-of-fire spectacle, the likes of which hasn't been seen in the continental U.S. for nearly two decades.

One clue to demand might be found at the planetarium at the University of Nevada, Reno, which had to order another 10,000 solar viewing glasses after it sold out of them ? 17,000 pairs at $2 each ? last week.

Religion is a potent force for cooperation and conflict, research shows

ScienceDaily (May 17, 2012) ? Across history and cultures, religion increases trust within groups but also may increase conflict with other groups, according to an article in a special issue of Science.

"Moralizing gods, emerging over the last few millennia, have enabled large-scale cooperation and sociopolitical conquest even without war," says University of Michigan anthropologist Scott Atran, lead author of the article with Jeremy Ginges of the New School for Social Research.

"Sacred values sustain intractable conflicts like those between the Israelis and the Palestinians that defy rational, business-like negotiation. But they also provide surprising opportunities for resolution."

As evidence for their claim that religion increases trust within groups but may increase conflict with other groups, Atran and Ginges cite a number of studies among different populations. These include cross-cultural surveys and experiments in dozens of societies showing that people who participate most in collective religious rituals are more likely to cooperate with others, and that groups most intensely involved in conflict have the costliest and most physically demanding rituals to galvanize group solidarity in common defense and blind group members to exit strategies. Secular social contracts are more prone to defection, they argue. Their research also indicates that participation in collective religious ritual increases parochial altruism and, in relevant contexts, support for suicide attacks.

They also identify what they call the "backfire effect," which dooms many efforts to broker peace. In many studies that Atran and Ginges carried out with colleagues in Palestine, Israel, Iran, India, Indonesia and Afghanistan, they found that offers of money or other material incentives to compromise sacred values increased anger and opposition to a deal.

"In a 2010 study, Iranians who regarded Iran's right to a nuclear program as a sacred value more violently opposed sacrificing Iran's nuclear program for conflict-resolution deals involving substantial economic aid, or relaxation of sanctions, than the same deals without aid or sanctions," they write. "In a 2005 study in the West Bank and Gaza, Palestinian refugees who held their 'right of return' to former homes in Israel as a sacred value more violently opposed abandoning this right for a Palestinian state plus substantial economic aid than the same peace deal without aid."

This dynamic is behind the paradoxical reality that the world finds itself in today: "Modern multiculturalism and global exposure to multifarious values is increasingly challenged by fundamentalist movements to revive primary group loyalties through greater ritual commitments to ideological purity."

Northland Natives Earn NSIC Golf Honors

(Northland's NewsCenter) --- Two Northland native golfers have earned all-conference honors after competing this season in the Northern Sun Intercollegiate Conference (NSIC), it was announced on Tuesday.

Virginia native Casey Hill, now a senior at Bemidji State, was named to the NSIC all-conference first team after leading the Beavers and the conference with a scoring average of 74.8 per round.

Hill qualified for the NSIC championship, carding a 12-over-par 296 to finish third. He was also named this year to the NSIC all-tournament team.

Grand Rapids native Matt McClure, meanwhile, was given NSIC all-conference honorable mention after finishing with a scoring average of 77.0 per round with the University of Minnesota-Crookston.

McClure also qualified for the NSIC championship, finishing 41st with a 42-over-par 326.

Large Fight With Baseball Bats Erupts on Cedar Rapids NW Side

CEDAR RAPIDS, Iowa - A big brawl in Cedar Rapids Tuesday evening sends six people to jail.

This happened around 7:00 PM near the corner of Jacolyn Drive and 1st Avenue NW outside of an apartment complex.

Police tell us forty to fifty people were fighting and smashing in car windows with baseball bats. The first officer on scene says he needed to bring his K9 officer, Marco, out of his squad car to end the brawl.

You may remember on Monday, Marco played a key role in ending the manhunt for 17-year-old Isaiah Sweet. The police dog cornered Sweet behind Theisen?s forcing him to surrender.

Police did not release any further details. No word on what initiated the brawl or if any injuries resulted from the fight.

Duck softball to host first ever NCAA regional

EUGENE - After polishing off one of its greatest regular seasons ever, the University of Oregon softball team (39-15, Pac-12: 13-9 (3rd)) was tabbed as the #11 seed in the 64-team NCAA Softball Tournament field announced Sunday night on ESPN-U.

Looking ahead to their 14th NCAA regional appearance, the Ducks are the top seed in the four-team regional that will be held in Eugene at Howe Field on Thursday-Saturday, May 17-19.

Other teams headed to the Willamette Valley to play in the double-elimination format include BYU (43-13), Mississippi State (33-22) and Portland State (27-23).

Game times are tentatively scheduled as follows (*times listed are Pacific Time):

3 p.m. - Game 1 - BYU vs. Mississippi State
6 p.m. - Game 2 - Oregon vs. Portland State

Earlier this season, Oregon beat Portland State in an April doubleheader in Eugene (10-4, 1-0), and was edged by BYU (2-1) in Tempe in the season-opening Kajikawa Classic in Tempe.

Returning NCAA tourney qualifier Portland State (27-23) won the Pacific Coast Softball Conference Tournament this past weekend with 6-1 and 1-0 wins over St. Mary's in the event's final two contests.

Returning Super Regional advancer BYU (43-13) won the Western Athletic Conference title in Las Cruces, N.M., last weekend with its wins over Louisiana Tech (6-1), No. 11 Hawai'i (6-4) and Fresno State (8-3).

Mississippi State (33-22) lost in the first round of the SEC Tournament last Thursday to NCAA tourney #2 seed Alabama by a 5-2 count in Tuscaloosa.

Oregon has played Mississippi State only once before (a 3-0 loss in Tempe), and owns all-time marks of 4-3 vs. BYU and 110-61 against PSU.

Looking ahead two weekends, the winner of the Eugene Regional will advance to play the winner of the Austin Regional hosted by #6 seed Texas (42-10). Other teams in that regional include Northwestern (27-27) and Auburn (33-21). If UT wins their regional, they will host the Super Regional vs. the Eugene Regional winner.

The tournament's other top-eight seeds included #1 California (50-4), #2 Alabama (50-7), #3 Arizona State (46-7), #4 Oklahoma (45-8), #5 Florida (46-11), #7 Tennessee (46-10) and #8 Texas A&M (39-16).

The remaining top-16 seeds included #9 Missouri (43-12), #10 Georgia (41-15), #12 UCLA (36-18), #13 Arizona (35-17), #14 Louisiana-Lafayette (49-4), #15 Louisville (53-3) and #16 Washington (36-17).

College softball fans can watch action from two regionals this weekend on ESPN2 and ESPN3 from the Louisville Regional (that included #15 Louisville, Kentucky, Michigan and Valparaiso) and Arizona Regional (that includes #13 Arizona, Hawai'i, North Dakota State and Notre Dame)

Next weekend, all eight NCAA Super Regonals will be televised live by various ESPN stations. The two-team, three-game format will be held on back-to-back days between Thursday-Sunday, May 24-27.

The Women's College World Series follows in Oklahoma City, Thursday, May 31-Wednesday, June 6, and every game will also be televised by the ESPN network.
